The main anti-war march at the Chicago Nato summit was marred by clashes between police and protesters, with several people injured and 45 arrests.

Thousands of people marched towards McCormick Place in the downtown area of the city, where 51 world leaders are meeting for the two-day summit.

However, the demonstration on Sunday ended in ugly scenes as police used batons to control the crowd. The violence came as a fifth person was charged with terrorism-related offences in in relation to alleged plots to disrupt the summit.

Sunday’s demonstration was the largest anti-war protest so far, after days of marches and protests in the city centre.

Gathering at Grant Park, thousands of protesters set off south towards the site of the summit, led by around 20 Iraq veterans against the war.

Arriving two blocks west of McCormick Place, the veterans, including Scott Olsen, the protester injured in Occupy Oakland demonstrations in October, staged a symbolic “returning” of their medals, tossing them in the direction of the sprawling conference space.

ew tactics have an old ring to them and low-income debtors are falling prey.

NPR just ran a story called “Unpaid Bills Land Some Debtors Behind Bars.” As they report, ”Here’s how it happens: A company will often sell off its debt to a collection agency, generally called a creditor. That creditor files a lawsuit against the debtor requiring a court appearance. A notice to appear in court is supposed to be given to the debtor. If they fail to show up, a warrant is issued for their arrest.” Marie Diamond has more.

This is increasingly common across the country. My colleagues Matt Stoller and Bryce Covert have both written about debtors being jailed for failure to appear in court. Debtors’ prisons are illegal, and some point out that this is really jail for a summons problem, not a payment. But I haven’t had a full vision of the practice until I read this excellent working paper by Lea Shepherd of Loyola Chicago law school, “Creditors Contempt” (h/t creditslips). Beyond laying out the problems with the current system, which gives a disproportionate amount of the coercive powers of the state to creditors, this paper also has implications for another topic I’m interested in — the class bias of the submerged state.

The key here is something called in personam debt collection remedies. In an agrarian economy, it was relatively straight forward for creditors to order a sheriff to seize the property of a debtor. In rem actions, where a sheriff would go and seize property, would work just fine. But this became harder to do as time went on.

The debt collection market evolved in personam debt collection remedies. This in personam action has two goals: discovery and collection. The court orders the debtor to disclose information about his property, location of his assets, etc. to help creditors track down those assets. Then the court orders certain payments to be made, which allows for collection. This court order is enforced through the court’s authority to hold debtors in contempt, which in turn is enforced through threats of imprisonment. Depending on the jurisdiction, contempt charges can be made against either the failure to show up for the discovery process or the failure to stick to the collection ordered.

Some pro-business federal judges have shockingly approved a constitutional right for big companies to avoid revealing product dangers on labels.

In recent years, corporate lawyers representing industries whose products touch millions of American lives have stopped numerous government efforts to better inform the public about possible health risks with an eyebrow-raising legal strategy. They have asserted a constitutional right not to speak, or say more than they want on labels and advertising, and pro-business federal judges have agreed, rejecting the public’s right to know.

In cases involving manmade hormones fed to dairy cows, heart and lung disease caused by tobacco, the nutritional value of foods contributing to childhood and teenage obesity, and even radiation emitted by cell phones, the industries keep returning to court until a business-friendly judge or majority on an appeals court rules that the First Amendment includes the corporate right not to ‘speak’ if it could harm profits.

“They invoke the Amendment’s protection to accomplish exactly what the Amendment opposes,” wrote U.S. Court of Appeals Judge Pierre Leval, in a lengthy dissent in an early case in which his peers sided with industry and cited the First Amendment to overturn a state law labeling hormone-containing milk products. “The majority’s invocation of the First Amendment to invalidate a state law requiring disclosure of information consumers reasonably desire stands the Amendment on its ear.”

The labeling cases are not the only way corporations have been seeking to enlarge First Amendment speech rights outside the political arena.

This past June the Supreme Court ruled that drug makers’ constitutional speech rights included ‘selling’ patient records, overturning a Vermont law that sought to keep the files private. Justice Stephen Breyer’s dissent said the Court was setting a dangerous precedent by allowing the First Amendment to be used to avoid reasonable government regulation.

“At best the Court opens a Pandora’s Box of First Amendment challenges to many ordinary regulatory practices that may only incidentally affect a commercial message,” he warned. “At worst, it reawakens Lochner’s pre-New Deal threat of substituting judicial for democratic decision making where ordinary economic regulation is at issue.”

Which Side Are You On?

The Transgender Borg and Transgender Inc put out a massive quantity of bullshit about identity and identifying as a woman, about how that identity trumps both physical reality and the perceptions of others. Based on the claims of some to be considered a woman all one has to do is claim to identify as such.

Being considered a woman doesn’t require being assigned female at birth.  Doesn’t require surgical sex reassignment from an initial birth assignment of male.  Doesn’t require the removal of testicles and definitely doesn’t require the surrender of one’s penis.  One isn’t required to live 24/7/365 in a socially accepted female sex role.  One doesn’t have to have electrolysis or even wear women’s clothing, according to Transgender Borg ideology to be considered a woman based on “identifying as a woman.”

Neither assigned female at birth nor later surgically reassigned as female women are permitted to have a say in this matter, but instead have to swallow the entire reactionary pile of crap regarding gender that we spent years fighting against.  Betty Friedan’s book The Feminine Mystique was all about how gender (sex) roles were used to trap women and limit their ability to function in the world as whole people with the agency to make their own decisions regarding the course of their lives.

For all of the Transgender Borg/Inc.’s  BS about deconstructing gender most of their philosophy seems deeply grounded in the reification of gender stereotypes as defining who is a man or who is a woman.

Indeed their ideology of “Transgender Umbrella” and “Transgender Community” seems intent upon stifling genuine attempts at breaking free from sex role/gender role stereotyping.  It is terribly oppressive to have your life colonized and be berated by the Borg/Inc for not embracing “Transgender as Umbrella” once they have decided you are part of a class that they have decided belongs under the “Transgender Umbrella.”

Speaking of “process”.  Isn’t there something incredibly phalliocentric happening when one group composed largely of penis people and their sycophants get to decide when some one is part of the “Transgender Community” or not, without the consent of the person or class of people being colonized?

I am well aware of Christan Williams attempts to write a form of revisionist history where  “Transgender” is a self chosen collective noun that was embraced as early as the late 1960s/early 1970s by women with transsexualism.

How does it feel, Christan, to be a sycophant toadie for a bunch of people who have advocated violence against feminist women, who had the courage to say no to the demands of phalliocentric transvestites and their demands to share the women’s room based on “identity”?  Identity with out actions that actually change your sex is meaningless, nothing more than a con game played by penis people who want to violate women’s privacy.

Don’t think I haven’t noticed the attempts at rehabilitating Angela Keyes Douglas, a psychopathic douche nozzle from the 1970s who hindered the integration of post-transsexual women into the feminist and lesbian communities with his androcentric “transgender superiority” and his calling  lesbian feminists  “ugly cunts” and “fish”.

BTW that word, “Fish”…  That’s the word that set the feminists off when it was used by Saint Sylvia during her drunken Pride Day Parade episode back in 1973.  Do you think that really gave post-transsexual women a big boost in the feminist community?  Or did it hurt us?

Many of us  look upon SRS as ending a chapter in our lives and with the end of that chapter come an end to membership in a shared class that has come to be called “The Transgender Community”.  At that point we face a life choice.  One road means we continue the process of becoming women, a process that can only happen if we drop the “Trans”.  That means dropping the “Transgender Community”.  It means embracing the bare unadorned label, “woman” with out the prefix “trans” much less the adjective “transgender”.

In spite of the TG Borg/Inc.’s protestations to the contrary one cannot identify as a woman and as transgender.  The two are mutually exclusive.  One might identify as a “trans-woman” or as a “transgender woman”, one might even identify as transsexual, although the term transsexual implies actual actions taken to permanently physically change one’s sex.  But as long as one either has to stick a prefix or adjective, or voluntarily sticks that prefix or adjective in front of the word woman then one is identifying with the modifying prefix or adjective and not with the noun being modified.

Being woman identified might have all sorts of readings and levels, take all sorts of forms from spiritual to political.

But one thing should seem obvious.  Living one’s life in transgender-centric surroundings is not conducive to taking the final step in the process of becoming part of the community of women.  It is continuing to live in the transgender ghetto.  One does not have to be hostile to genuine transgender people nor wish to deny genuine transgender people their rights.  But who is actually transgender?  This is a reasonable question. I had a hostile transvestite who goes by the on-line name of Carolyn-Ann come here a while back with his penis waving transvestite BS.  He got pissy when he found out I wasn’t about to be bullied by him and has periodically trashed me on his blog ever since.  Do I have to consider him a woman, or welcome him into women’s space?

Speaking of women’s space…  Many of us have been welcomed into women’s space based upon our work within the feminist and lesbian communities, our personalities.  Even the Michigan Women’s Music Festival quietly expanded its policies to permit women identified post-transsexual women into the festival.  Yet Camp Trans continues as many will not be satisfied until people with penises can invade any and all gatherings of women.

I have been accused of being a “genital surgery essentialist” by Autumn Sandeen.  Monica Roberts, who has advocated violence against Cathy Brennan and Elizabeth Hungerford, suggesting they should be pimp slapped and condoning a transvestite named Anthony Casebeer suggestion that these women be attacked with a baseball bat.  Monica Roberts, who often points out racial injustice is equally often given to hyperbole and regularly engages in phalliocentric dismissals of post-transsexual women, snidely implying that women born transsexual has racist connotations with her oh so cute”WWBT” and her disparaging of our bodies as having man-made vanilla scented neo-coochies.

Nice going Monica.  You have insured the heightening of the contradictions.

One can be woman identified or one can be part of the phalliocentric Transgender Borg Collective.  One cannot be both.

I consider the attacks upon Cathy Brennan and Elizabeth Hungerford to be unwarranted, nor do I see any real merit in the arguments coming fron the TG Borg/Inc.  The inclusiveness of the “Transgender as Umbrella” paradigm is its weakness not its strength.  They use post-transsexual women as a front when so many of them are men in their daily lives.  The refusal to limit Transgender to people who live 24/7/365 when writing legislation that grants entry to restrooms and other spaces where women expect a reasonable level of privacy, causes many women to be reasonably wary, to ask just what this means.

When post-transsexual women who have been around the scene and know what is going on because they have seen the reality take sides in this issue one may justifiably ask, “Do you stand with women, or do you stand with transvestites?”

I have been called a “radical feminist” by some in the TG Borg/Inc.  I guess I am, if that means I put the interests of women either assigned female at birth or surgically reassigned as female at a later time ahead of the interest of either transgender people or transvestites.

I put women without a prefix or adjective and their interests first, because that is what being woman identified requires.  Being woman identified isn’t an identity or make-up and clothing.  It is a commitment to women, both because you are a woman and because you put the interests of women first.

Over one hundred protesters from the Appalachian coalfields were arrested in front of the White House today, defiantly calling on the Obama administration to abolish mountaintop removal mining. As part of the Appalachia Rising events, the coalfield residents took part in a multi-day series of events to bring the escalating human rights, environmental and health care crisis to the nation’s capitol.

Kentuckians for the Commonwealth leaders Teri Blanton and Mickey McCoy, the first arrested in today’s nonviolent act of civil disobedience, were joined by allies from around the country, including NASA climatologist James Hansen. Meanwhile, protesters led by the legendary Rev. Billy Talen staged a nearby sit-in at the office of the PNC bank, which remains one of the last major financiers of coal companies engaged in this extreme form of strip-mining in Appalachia.

In a stark reminder of the national connection to the coalfields, the Obama administration officials looked on from their White House offices, as their electricity came from a coal-fired plant generated partly with coal stripmined from Appalachia.

As a litmus test of the administration’s commitment to science and the rule of law, Appalachian residents are calling on the EPA to halt any new permit on the upcoming decision over the massive Spruce mountaintop removal mine.

Mountaintop removal coal only provides, in fact, less than 10 percent of all coal production.

Blame the Ultra Right Wing Extremist Republicans

I’m tired of liberals, progressives and especially LGBT/T folks blaming the Democrats for actions of the ultra right wing Republi-Nazis.

As the late Molly Ivins used to say, “You got to dance with them that  brung you…”

We don’t have a Progressive Party.  Every attempt that has been made to build a third party has been performed top down and ass backwards.  The most recent example being “The Green Party”, which is now mostly a burnt out shell funded by Republi-Nazis.  Before that there was “Peace and Freedom”.  The lesson that needs to be learned is, “You do not start a political party to run someone for president.  You start by running someone for school board.”

We have spent the last 40 years or so engaging in self-defeating behavior including identity politics, only organizing among people like ourselves.

The Civil Rights Movement of the early 1960s crossed racial lines.  It may have seemed patronizing to some but a multi-racial movement had seriously left wing progressive roots and the potential to unite poor black and poor white people as well as the better educated  and higher up the class structure, leaders.  One year to the day after Martin Luther King started talking about matters of class and how poor whites and poor blacks were in much the same boat when it came to opportunity, they killed him.  They being the Vast Right Wing Conspiracy.

Hillary was right on that one, there is a “Vast Right Wing Conspiracy” in this country.  It is both long standing and powerful, backed by moneyed interests like Murdoch, Mellon-Scaife, and Koch.  They own the media, fund right wing think tanks, and fund astro-turf organizations like the Tea Baggers.  They are in a partnership with the religious right, which is funded via tax free tithings from their flocks.

They have a police state on their side that has the power to disrupt and destroy any movement that threatens to actually stand up for equality and social justice.  They infiltrate and subvert our movements, sow dissension and suggest we get apathetic.

They whisper in our ear, “Aww the Democrats didn’t get you what you wanted.  Why don’t you show them who is boss and sit this election out?  Why don’t you withhold money from them?”

Of course Democrats aren’t helped by having a bunch of oh so nice wimps on our side.  You know the kind, the ones who spew the lines about how calling Republi-Nazis the same sorts of names they call us is stooping to their level.  Shit, the oh so nice wimps don’t even want us to bring a knife to a gun fight, they want us to bring kind platitudes, an oath to passivity and a flower to that gun fight.

And at the first sign of failure on the part of the Democrats they want to give up.

Fuck that shit.

We let those Nazi dickwads funded by Breitbart  destroy ACORN, a truly progressive organization and we didn’t put up a protest or a fight.  We have let the media give these bestiality loving Nazis like that cum bag Paladino and self avowed Satanist Christine O’Donnell all the publicity while they ignore serious Democratic candidates who might be better equipped to govern this nation.  We aren’t making a huge uproar when Tea Bagger candidates suggest committing genocide on LGBT/T people by invoking the imprimatur of  “The Bible” and “God”.

It is time to get tough.  Out organize them and take seats from them rather than giving up seats.  If they sling one clod of mud at one of out candidates dump a truck load of manure on theirs.

The corporate funded media have treated ultra right wing airheads like Rand Paul as people to be taken seriously, when in reality they are insane and their ideas are totally un-American.

Speaking of which…  Remember Molly Ivins?  She said of Pat Buchanan’s speech at the ’92 Republi-Nazi Convention, “It probably sounded better in the original German.”

We have let these Confederate flag and Nazi values assholes trademark “American Values” and after giving them exclusive rights of usage allowed them to pervert those very same values into something I sure as hell do not recognize as American Values.

I was pretty proud of how far we have come when we elected President Obama, even prouder still when the nomination came down to being between a man of color and a woman.  When I looked at our convention I saw the common people who make up the beautiful tapestry of this diverse nation, and I was proud to be a Democrat.

Not that the Democrats have gotten me the things I want but they have at least tried.

When I looked at the Republican Convention, my only comment was….  “I…I…see white people…” They do not represent us.  The majority of the people of this nation including the majority of Republican voters support the repeal of DADT.

We have about 45 days to work for the party.  Less than half a month to show we refute all the Birther lies about Obama.  45 days to show the world how proud we are of all sorts of people, of all different races and sexualities as well as classes all pulling our oars in the same direction in 2008 to elect the first President , who wasn’t a white male.

Even if we are disappointed this isn’t a time to retreat or to surrender… And damn it I am sometimes seriously disappointed with both Obama and with our congress.  I want them to fight harder but then I realize that we Democrats are a wishy-washy bunch and we don’t like fighting.  Say something is “socialist” and we fold when we could fight for it instead and make the Democratic party represent the sort of democratic socialism they have in much of western Europe.

Am I disappointed with not having Single Payer, inclusive ENDA, the Repeal of DADT and Marriage Equality?  Damn right I am.  But giving in now means never getting those things.  Giving in now means letting a bunch of racist, homophobic bigots who care only for the interests of the rich win.

Now isn’t the time to mourn our failures. Now is the time to organize.

Wal-Mart Asks Supreme Court to Weigh In on Suit

Wal-Mart Stores asked the Supreme Court on Wednesday to review the largest employment discrimination lawsuit in American history, involving more than 1.5 million current or former female workers at Wal-Mart and Sam’s Club stores.

Nine years after the suit was filed, the central issue before the high court will not be whether any discrimination occurred, but whether more than a million people can even make this joint claim through a class-action lawsuit, as opposed to filing claims individually or in smaller groups. In April, the United States Court of Appeals for the Ninth Circuit in San Francisco ruled 6-to-5 that the lawsuit could proceed as a jumbo class action – the fourth judicial decision upholding a class action.

The stakes are huge. If the Supreme Court allows the suit to proceed as a class action, that could easily cost Wal-Mart $1 billion or more in damages, legal experts say.

More significantly, the court’s ruling could set guidelines for other types of class-action suits. “This is the big one that will set the standards for all other class actions,” said Robin S. Conrad, executive vice president of the National Chamber Litigation Center, an arm of the Chamber of Commerce, which has filed several amicus briefs backing Wal-Mart.

“MSM” Revisited: Trans Inclusion in LGBT Medical Study

Recently, I’d blogged about a term that’s increasing in usage in HIV research and outreach: “MSM,” or “men who have sex with men.”  The term was originally invented because of a need to include not just sexually active gay men but also bisexuals and men who are not gay-identified but for whatever reason have casual or incidental sex with men.  It can also include gay- or bi-identified trans males, although they’re often overlooked in the study (or sometimes even thought not to exist).  And, of course, it’s often asserted that it includes or intends to include trans women.  I’d commented:

I get it that effective terminology must be given to identify target high-risk groups for the sake of study.  I get it that the terminology needs to be both simple and encompassing.  I get it that HIV is a serious issue and relevant to the trans community, though not all trans sub-groups are high-risk.  I get it that penile-anal intercourse (PAI) risk groups can include trans women….  What I don’t and will not get is the gay community’s insistence that transsexual women are “really men” and how it’s such a bother having to state otherwise in order to be inclusive.  To be fair, there are many folks in HIV study and advocacy who don’t feel or act that way, but the prevalence of MSM-exclusive study sure reinforces this impression.

As diverse as the trans umbrella is, where MSM really fails is primarily when female-identified or dual-identified trans people (usually transsexual women) are forced into one of those “M” designations (i.e. also encompassing straight-identified men who date trans women).  This is often justified by researchers through noting other cultures where trans women sometimes do identify themselves as “really a man,” because they have not yet had the freedom to develop a language with which to self-identify, and therefore accept the language and logic that is available to and used on them.  For something that was supposed to have been devised in order to respect different male identities and transcend constructions built around terms like “gay,” people sometimes wonder why it’s such a big deal when trans women are similarly not accommodated and their identities as not men are not respected.  Especially when this is the result:

This past Spring, I’d had one such study request forwarded to me by someone who was apparently on one of the mailing lists that I forward communications to.  A few days later, he wrote me, irate that I’d not forwarded it to my trans networks.  I’d pointed out (feigning ignorance) that while a few trans men might qualify and be interested, much of what was being discussed in his email didn’t really fit FTM configuration, or at least pre-surgical.  This resulted in a missive which started off with “you know what I mean” and launched into an accusation that I’d be “guilty of the murder of” every transsexual woman who perished from HIV who might have benefited from the study.  And yet, the survey was written so thoroughly to exclude those of female gender identity, I can’t see any way that any self-respecting trans woman would be able to sit through the whole thing without becoming thoroughly incensed at the obvious refusal to dignify her as who she is.

Additionally, many trans women never have sex with men, being either lesbian-identified or not sexually active.  And for a small few of us, HRT isn’t kind, and it becomes an either-or proposition where we really do have to choose between transition and sex.  So an assumption that all trans women belong in the study is as inaccurate as the assumption that all trans men don’t.

But the solution does get fuzzy.  I’m no longer convinced that any permutation of “MSM + …” works effectively at all (and I see in my original article some failures to look outside transsexual identities to the nuances pertaining to some other flavours of trans).  Possibly some terminology along the lines of PAI practices should be considered, but it’s obvious that the status quo needs to be replaced with something more appropriate.  And if that discussion needs to happen anywhere, it needs to start in the larger LGBT sphere.

This situation is also symptomatic of a fuzzy understanding of trans realities when it comes to inclusion in LGBT medical studies in general.  Trans brings along with it a host of medical questions that are often entirely overlooked in such studies.  Which is fine if the study is presented as a general overview that is not reflecting on trans-specific care or pretending that it encompasses all the issues of the included study groups.  I also get that adding all aspects of trans to a study that is aiming to look at primarily cisgender medical issues will confuse it beyond recognition.  However, too often, these studies use the fact that there is a “transgender” checkbox in the Sex question to claim that what is presented is comprehensive and targets all the LGBT medical issues that need to be addressed — which leads researchers and medical professionals to conclude that they do not have any need to look further.

When transsexuals are factored in, there are numerous medical realities surrounding access to and cost of treatment, the fact that said treatment is part of a necessary course to righting one’s life, issues around hormone access and use, or access to surgeries or tests (i.e. obtaining a mammogram for someone with a penis, or finding a surgeon willing to perform a hysterectomy on a man).  Even outside the transsexual process, we find unique issues affecting genderqueer identification, or the existence of another DSM diagnosis intended for crossdressers (and which serves no useful purpose beyond stigmatization as well as the annexation of transsexuals): Transvestic Fetish.

Superficial inclusion can generate problems with survey questions like, “Have you ever been diagnosed with a mental illness?”   Is this supposed to include GID?  If so, isn’t that a bit like rubbing one’s nose in the fact that our little community still carries this stigma?  And if there is no means to elaborate, how are the people conducting the study ever going to know if the respondent is referring to GID (or TF), or to something else entirely?

Such surveys can often be accompanied by assumptions: the assumption that we’re sexually active; assumptions that we engage in risky sexual behaviour; sometimes assumptions that ones genitals dictate how they should be addressed; assumptions about who we’re attracted to and sexually active with; assumptions that we can see just any medical professional when we need to; assumptions that prejudice in the clinic could never take the form of being treated like we’re deluded or freakish by the doctor, medical staff and/or other staff; assumptions that we can access HRT, surgery and other forms of treatment without requiring letters of permission from someone who has psychoanalyzed us; assumptions that anyone with a trans history has to identify as trans(fill-in-the-blank), rather than as male or female.  It can also overlook issues entirely, such as that of changing one’s name on file, having it acknowledged by staff, and not having it create a crossed-wires situation were your lab tests from elsewhere don’t get where they’re supposed to.

And finally, there is an issue of relevance.  When trans-specific care isn’t in the study at all, what remains seems almost irrelevant or even foreign to trans participants.  It does seem a little humorous to me to be asked, for example, “Do you trust your medical provider enough to discuss issues with him or her that might out you as being LGBT?” when an adam’s apple (not to mention genitalia), medications, gender markers on identification or surgeries recorded on file all leave no doubt.

I don’t mean this to be entirely scathing — studies do vary, and I’m elaborating on the worst I’ve seen in order to open discussion on making them better overall.  While the MSM terminology is glaring, many other issues stem from cisgender privilege — not in the sense that cisgender people often complain about being accused of (i.e. wilful ignorance), but from the privileged standpoint of never having experienced these things, and therefore not realizing that they need to be addressed.

There is a concern that conducting separate studies can be seen as a license to not do trans population studies at all.  But because the medical situation can be significantly different for trans people, I wonder if these issues would be best handled as a trans-specific addendum?  And where language fails altogether — terms like MSM — there is a serious need for reassessment.

Gender… Schmender #$%@&^*

The whole ideology of gender is purely sexist bullshit.

Gender is a pure social construct, a fiction that oppresses both men and women but more women than men.

When I hear “gender assigned at birth” I want to slap someone. I wasn’t assigned a gender at birth.  The doctor looked between my legs and said, “It’s a boy.”  I was assigned male by reason of having a penis there later in life I had an operation that reassigned me to female based on that same genital appearance factor.

When I came out in 1969, I came out as a feminist.  Women in the collective gave me clothes. While the guys claimed they respected me but they also started treating me in a way that told me they expected me to adhere to the sex roles both hippie and movement women were expected to adhere to.

When other movement women saw this they introduced me to feminism.  When SDS split into Weatherman and other factions I became Weather, largely because of Bernadine Dohrn.  You see there weren’t very many strong women’s voices in SDS and the Anti-War Movement.

Bernadine Dohrn gave great rants…  Maybe months later on reflection you went WTF but at the time…  Oh how I admired her audacity and how she inspired me to act courageously.

I also learned from other radical women. Putting women and the interests of women first yet never forgetting that sexism was only one axis of oppression. Consciousness raising and analysis gave me/us an understanding of what the world expects of women.

Many of us who were dealing with having been born with transsexualism owe far more to feminism and the feminist movement than we ever did to Stonewall and the Gay Liberation Movement. We weren’t gay men even if we had male lovers.  Especially if we had male lovers… being transsexual and having a male lover meant we were straight or more accurately heterosexual since straight also had other connotations.

We weren’t some “T” so recently grafted on to what was first a Gay Liberation Movement.  We were women in transition to female having to deal with the same sexism as natal female women had to deal with.  It didn’t much matter if we were radical feminist Weather Nation women or Cosmo “Sex and the Single Girl” women.  We had to deal with sexism and pay discrimination as well as sexist assumptions based on what are now called “gender” stereotypes.

Gender was something used to keep women oppressed.  It was the idea that women are weak and stupid; fit only to be sex objects or mothers. Daddy’s little princess until given to a man only to lose her last name and become his property.* Gender became a way of telling feminists that they were not real women since they questioned the marketing of very high profit items based on pandering to a sense of insecurity in one’s own womanhood or attractiveness.

When feminism challenged those who were dealing with transsexualism part of the challenge was due to the tendency of so many of us to embrace all the marketing of gender without insight or even a sense of irony.

But gender as it is so often used today is if anything a far more sneaky and loaded with subtextual readings semiotic. Gender has now replaced sex in so much of the common discourse that we look at the construct as reality and skip over the subtextual readings of the semiotic.

Whereas once upon a time the Cockettes Troupe in San Francisco deconstructed gender and showed it as performative through the usage of exaggerated costumes and the performing of equally over the top stereotypes taken from films of the 1930s and 40s I now have some people ask if these performers were transsexual or transgender. The answer is maybe some were.  One was in the Stanford program at the same time I was, others were gay men and some were natal females.

By breaking the rules of gender through Absurdist Theater they created both campy comedy and a critique of sex roles. One of the crucial mistakes in feminist criticism of more traditional drag is the assumption that women are the target when it often seems the aim is more a matter of ridiculing roles portrayed in movies.

But Second Wave Feminism went even further in delivering a devastating critique of sex roles as defining what the proper role of women was.  When women dared step beyond the stereotypes and enter male dominated career field they were told that doing so would un-sex both women and men.  Fashion magazines and all sorts of corporate interests dished up massive loads of propaganda aimed at undermining the confidence of women seeking equality of opportunity.

One of the critiques of transsexual to female people is that we have not been socialized as women. This is an assumption that is often times contradictorily both true and false. Transsexual to female people grow up as transkids and are influenced by the same sales pitches and indoctrination as natal women yet they are told it is something they must adhere to and we are told it is something to be ashamed of.

This makes it hard for us to have a critical eye regarding this propaganda when we first come out. We may acquire it with experience but it is equally possible for us to join the masses of women who march to the beat of Sex in the City rather than to NOW and more radical feminisms.

At some point sex became gender and roles acted replaced that which was written upon the body. The ironic labeling of sex as a definer of maleness or femaleness as essentialism has resulted in many people with a poor understanding of feminist theory using it as a careless accusation.

Dividing people into classes of male and female based on the appearances of genitalia would mean that heterosexual post-SRS women and men would be able to legally marry partners of the other sex.  No more Christie Lee Littletons, no more Nikki Araguzs.

But when the misogynistic reactionary forces of both religious fundamentalism and ultra right wing politics united to defeat feminism as well as LGBT/TQ liberation and the progressive movements of the 60s and 70s they seemed to unite with corporate interests in reasserting misogyny.  Trying to sell sex roles and their importance after 15 years of serious feminist critique was more of a struggle than repackaging sex roles as gender.

The Total Woman by Marabel Morgan was supposedly a self help book for women.  In reality this 1974 publication was grounded in the rising right wing Christo-Fascist backlash that also spawned the rise of the homophobic bigotry of Anita Bryant and crew.

Along with Phyllis Schlafly these genderists put forth an ideology that could have been penned by the late transvestite activist pioneer, Virginia Prince.  The ideology was one that kept women in their places by telling them that they weren’t real women unless they filled this total woman gender role.  The same gender role feminists had critiqued under the name of “sex roles.”

Now I view “gender” as a culturally defined social construct that varies a great deal according to culture and time (see Margaret Mead’s work.  BTW her “debunker” were right wing McCarthyites).

With western modernism the naturally occurring over lapping of sex traits and abilities lead to a lessening of rigid gender roles that are more often found these days in non-western cultures.

Defining people as real men or real women based on gender is a characteristic of conservative values often based in religiously fanatical cultures which is why I find the embrace of “gender” as definer by Transgender Inc. to be more reactionary than progressive.

In the real world an Emo boy even with nail polish and a magenta streak in his long black hair is still a boy.  The rocker girl with facial piercings, tats and black leather motor cycle boots is still a girl.

Of course without the ideology of transgender Thomas Beatie is a masculine woman who dresses and acts like a man when she isn’t having children.  But c`est la vie.  And no I wouldn’t mis-gender him like that even though I am supremely irritated by the neo-quiver full thingie.

Gender is masculinity or femininity not maleness or femaleness.  We got suckered into discussing that core identity of male or female as being gender based on Stoller’s book (Sex and Gender) way back in the 1960s.  We didn’t have a whole lot of information to operate on and lacked a vocabulary to describe what we were feeling.  We should have used “core sex identity” for that sense of being female trapped in a male body.
Little did we realize that even then introducing “gender” in to the discourse was using poisoned seeds from the fruit of a poisonous tree.  The misogynistic world according to Virginia Prince became the bullshit crop of the transgender social construct of gender.

The way Transgender Inc. uses gender is not the least bit liberating.  It can’t be as it is based on a construct that defines membership in the sex class of female or the sex class of male not based on what one commonly uses.  Male and female are generally based on whether one has a penis or vagina.

Yet the simple reality of hole or pole unites both Transgender Inc and the religious fanatic/right wingers in finding ways to tell women born transsexual that their pussies do not really make them women.

Over the past two months, many Republican pundits and members of Congress have been calling for the end of unemployment benefit extensions for the millions of Americans who can’t find work. Meanwhile, GOP Senators held the unemployment insurance (UI) extension bill hostage for weeks as 2.5 million Americans were left without the “desperately needed lifeline” of UI benefits. Even as five workers fight for every one job opening, Republicans are still calling the unemployed “spoiled” and suggesting that blocking benefits is fine because it only affects a “small amount of people.”

Last week at a fundraiser for Michigan GOP congressional candidate Rocky Raczowski, conservative pundit Phyllis Schlafly added her voice to the chorus crying out against government assistance for the poor or unemployed:

One of the things Obama’s been doing is deliberately trying to increase the percentage of our population that is dependent on government for your living. For example, do you know what was the second biggest demographic group that voted for Obama? Obviously the blacks were the biggest demographic, y’all know what was the second biggest? Unmarried women. 70% of unmarried women voted for Obama. And this is because when you kick your husband out, you’ve got to have Big Brother Government to be your provider. And they know that. They’ve admitted it. And they have all kinds of bills to continue to subsidize illegitimacy…

The Obama administration wants to continue to subsidize this group because they know they are Democratic votes.

Schlafly’s argument is specious. She talks about “subsidizing illegitimacy,” but not all single women are mothers. Less than 20 percent are mothers to young children. The rest include millions of widows, millions of young never-married women, and plenty in between — some of whom have kids, but most of whom do not.

FBI admits probing ‘radical’ historian Zinn for criticizing bureau

While many babble on about how free people are in America I have tended to question the reality of that freedom. Too often that freedom seems to mean one is free to work wages so mean and parsimonious as to give meaning to the term “wage slavery”.  Oddly that freedom doesn’t seem to extend to the rights of labor to organize, form unions and strike for better conditions, otherwise why would workers who try to exercise that freedom be fired, subjected to beatings and arrest or sometimes even murdered by those who are authorized to enforce the nations laws.

Why are people of color, women, LGBT/TQ people considered subversive and anti-American when they ask that the nation that claims to stand foursquare for freedom, justice and equality honor those claims by giving people of color, women and LGBT/TQ people those things the nation says it is most proud of.

Why are those who peacefully dissent and point out the short-comings, the bait and switch nature of these claims spied upon by secret police when our government tells us that only totalitarian governments use secret police to spy upon citizens who peacefully dissent.  Why is it okay for a nation that claims to stand for freedom of speech turns around and black lists those who have the audacity to speak out against the injustices of racism, imperialism, sexism and homophobia?  Are terminations and black listing the marks of freedom or of an authoritarian police state?

Is it more radical to petition an authoritarian state to be allowed to become part of that authoritarian state than it is to work to end the authoritarian state that oppresses so many?

The late Howard Zinn exposed the reality behind America’s image and showed us how it was so often a bright and shining lie.

For this he was investigated by the FBI and I am sure by secret police squads all over the country.  His crime being a truth teller with the courage to speak that truth to power.  I am not surprised at their attempts to have him fired and blacklisted as that is the nature of those involved in the maintaining of the authoritarian aspects of corporate freedom and the government by and for the rich.

FBI files show bureau may have tried to get Zinn fired from Boston University for his political opinions

Those who knew of the dissident historian Howard Zinn would not be surprised that J. Edgar Hoover’s FBI kept tabs on him for decades during the Cold War.

But in a release of documents pertaining to Zinn, the bureau admitted that one of its investigations into the left-wing academic was prompted not by suspicion of criminal activity, but by Zinn’s criticism of the FBI’s record on civil rights investigations.

“In 1949, the FBI opened a domestic security investigation on Zinn,” the bureau states. “The Bureau noted Zinn’s activities in what were called Communist Front Groups and received informant reports that Zinn was an active member of the CPUSA; Zinn denied ever being a member when he was questioned by agents in the 1950s.

“In the 1960s, the Bureau took another look at Zinn on account of his criticism of the FBI’s civil rights investigations.”

Today, U.S. District Court Judge Joseph L. Tauro ruled that Section 3 of the Defense of Marriage Act (DOMA) is unconstitutional with respect to claims brought by seven married same-sex couples and three widowers from Massachusetts. Under the ruling, the plaintiffs are entitled to the same federal spousal benefits and protections as every other married couple.

The ruling stems from GLAD’s lawsuit Gill et al v. Office of Personnel Management et al, filed in March 2009.

“Today the Court simply affirmed that our country won’t tolerate second-class marriages,” says Mary Bonauto, GLAD’s Civil Rights Project Director, who argued the case. “I’m pleased that Judge Tauro recognized that married same-sex couples and surviving spouses have been seriously harmed by DOMA and that the plaintiffs deserve the same opportunities to care and provide for each other and for their children that other families enjoy. This ruling will make a real difference for countless families in Massachusetts.”

I was at College and University, the southern boundary of Queen’s Park, at about 5pm on Saturday as police began to clear the so-called free-speech zone. It was appalling. I watched as a few were arrested and saw mounted police carve a group of people out of the crowd in the park and arrest them all.

A woman arrested for public lewdness for allegedly having sex in a park is facing a surprising additional charge: cheating on her husband.

No, this wasn’t in a Muslim country far away, it is happening in New York.

Suzanne Corona, a 41-year-old woman from Batavia, N.Y., just east of Buffalo, was busted along with 29-year-old Justin Amend last week, police said.

The pair allegedly were having sex on a picnic table near a playground in Farrall Park just after 5 p.m. on Friday, according to WHAM 13. Police report several parents and children were nearby.

“[The police officer] asked them what they were doing, and they said, ‘Just talking,’ and obviously they weren’t just talking,” said Officer Eric Hill, of the Batavia Police Department.

The police in this country have long exhibited Nazi thug tendencies.  From the beatings and murders of union organizers to the arresting and beating of civil rights demonstrators one sees a pattern of anti-human rights abuses.

Of late the military and the police have been invaded by too many Christo-fascists who see these agents of authority positions as empowering them with the ability to enforce their twisted version of the Abrahamic desert mythology.

One expects better of places like New York…  Perhaps it is time for New Yorkers to rethink the Disneyification  of they once international famous cosmopolitan city.

Worker Bees and Caffeine, the Legal Drug

Here I am at six thirty in the morning facing another 9-10 hour day filled with stress.  Before me is a huge cup of coffee, the legal stimulant drug that gets me through the day.  Along with “energy drinks”.

I go to work where conformity is demanded and individuality suppressed.  Out on the floor the disgruntled murmur and anger runs skin deep. The name of the game is selling, pushing product with smiling enthusiasm even if the product has so much fat in it or so much sodium that it should wear a skull and cross bones.

Workers are treated like children and act out in a passive aggressive manner.

The stress of part time work in retail is brutal with its fluctuating hours meaning one can never count on a certain amount of pay when ones check come out.

Workers can be forced to pee in cups or the more modern swab instant drug test that gets so many false positives particularly in older workers who are often on a shopping list of medications.

Coffee is the perfect drug.  It helps the focus and boosts both energy and fake enthusiasm. Work turns us into corporate liars and caffeine helps us with the guilt.  We learn to project a false sincerity in order to sell and keep our jobs secure.

Insecurity is the life blood of the retail slave.  We eat insults and customer condescension with a smile knowing that many doing the condescending are but one more economic down turn, one more round of out sourcing or right sizing by the corporate raiders and junk bond peddlers, from joining us.  Welcome to Thomas Friedman’s globalized flat earth.  Welcome the race to the bottom when it comes to paying workers.

So lift your cup of coffee high in a toast to the death of the middle class.  Welcome to the world of the bottom line.

Welcome to the world created by the “free market” and the class war that created the super rich.  Thank the neo-cons and neo-libs who brought us here.

And if you are a straight person of color or a white LGBT/T person welcome to the world where we waste our time on horizontal hostility while those with the money who created this world use us as scapegoats to distract us from who the real oppressors are.

When I was in Saudi Arabia, I had tea and sweets with a group of educated and sophisticated young professional women.

I asked why they were not more upset about living in a country where women’s rights were strangled, an inbred and autocratic state more like an archaic men’s club than a modern nation. They told me, somewhat defensively, that the kingdom was moving at its own pace, glacial as that seemed to outsiders.

How could such spirited women, smart and successful on every other level, acquiesce in their own subordination?

I was puzzling over that one when it hit me: As a Catholic woman, I was doing the same thing.

I, too, belonged to an inbred and wealthy men’s club cloistered behind walls and disdaining modernity.

I, too, remained part of an autocratic society that repressed women and ignored their progress in the secular world.

I, too, rationalized as men in dresses allowed our religious kingdom to decay and to cling to outdated misogynistic rituals, blind to the benefits of welcoming women’s brains, talents and hearts into their ancient fraternity.

In the next few weeks, President Obama, Speaker Pelosi, and their homosexual and transgender allies will attempt to ram through the so-called Employment Non-Discrimination Act

What you may not know is that ENDA normalizes and provides special federal protection for 30+ bizarre sexual orientations listed by the American Psychiatric Association – the so-called “Dirty 30.” These 30+ fetishes include behaviors that are felonies or misdemeanors in most states.

ENDA’s “Dirty 30” includes such bizarre criminal acts as incest, pedophilia, prostitution, beastiality, and cross-dressing. If we don’t act today, Obama and Pelosi will normalize these disorders by federal law on April 21!

In a moment of candor, liberal Rep. Alcee Hastings (D-FL) openly admitted on the House floor that the “Dirty 30” would be covered by federal law. If Obama, Pelosi, Hastings and the Congressional Democrats pass ENDA, co-workers will be forced to work alongside individuals with these bizarre sex fetishes. Christian businesses will be directly impacted by ENDA. They would be forced to hire or retain cross-dressers and individuals who engage in these sinful behaviors. Students will be indoctrinated that “alternative lifestyles” are no different than traditional lifestyles. Young children will be forced to learn about these bizarre sexual fetishes – and you will have no say in the matter.

Alternative Medicine or Quackery?

Over the last year this blog has cast a seriously skeptical eye on the proliferation of highly dubious claims by people with transsexualism or transgenderism to being physically intersex rather than TS or TG.

The examination of these claims to improbable intersex conditions was prompted by things we were reading on a mailing list that was founded with the purpose of removing GID from the DSM.  We were going WTF? WTF? Particularly, considering  the majority of these claims were not coming from kids who might have exhibited a physical appearance that would have caused someone  looking  at them, even as they were dressed as boy. and say, “My that kid looks more like a girl than a boy”.  Kids whose bodily build would indicate a failure to masculinize.

Instead, the bulk of these claims were coming from transsexual or transgender people who had fathered children.  In some cases these  people were also claiming they were physically disabled and therefore could not actually transition.  Nonetheless they were real women and those of us who did not join them in these claims of intersex no matter how improbable, were not.

We are seriously concerned that this proliferation of dubious claims of intersex conditions by all these people who were and are transsexual could be used to hinder the effort many of us are exerting to remove GID from the DSM.  After all we are in the unfortunate position of having to prove our sanity, something that is difficult enough for a stigmatized class of people to accomplish.  One of the major charges against us is that we are delusional, detached from reality, perhaps even psychotic.  Another charge is that we are compulsive liars, incapable of telling the truth or perhaps in even recognizing it due to our detachment from reality.

Several of us have been on line friends for years now.  We have seen the vicious results of the frauds with many names who burned not only us but respected researchers.  I speak of Kiirea Tirea and Cheryl Chase as well as their many sock puppets who taught us to question the often carefully researched claims of obscure and exceedingly rare conditions.  Particularly since these very same individuals were also engaged in supporting Bailey, Blanchard, Lawrence, Zucker et.al..

Often times the same people making these bizarre claims to improbable if not impossibly contradictory forms of intersex are the very people most actively engaged in attacking transsexual and transgender people as perverts and “men in dresses”.  It doesn’t take a degree in psychiatry to see the internalized transphobia on the part of these individuals.

Some of these same individuals regularly push HBS as a replacement for transsexualism and claim membership in an elite group of “classic transsexuals”.

Oddly enough even though our exposing of the dubious nature of these bizarre claims of improbable intersex conditions was not originally aimed at specific individuals beyond Tirea and Chase as well as the people on GID Reform, various people acted like the cinematic vampires who are suddenly exposed to sun light.

Zoe, a resident of New Zealand, who seems to spend some 18 hours a day on line posting her claims everywhere and anywhere has been one of these vampires, accidentally caught in the sunlight when people on this blog mainly myself and Andrea Brown pierced the cloak of self serving deceit.  We were not initially focused upon her but her claims of spontaneous mid-life change of sex challenge anyone with any real knowledge of the conditions she cites.  Yes it is true fish do change sex in at least certain species.  And yes there is a small group of people with a hormone processing defect that delays physical masculinization until the onset of puberty.

But this does not make what Zoe states terribly credible.  Zoe is transsexual and has a great deal of internalized transphobia this causes her to have to justify being transsexual with an elaborate web of contradictory claims to being intersex.

Her basic impulse is to not own up to her dishonesty but to try piling on more BS.  This cause her to become more and more like Tirea and Chase.  She uses someone,  as an assistant, M. Italiano, MB BS (AM) Board Certified in Alternative Medicine (India) in an attempt to discredit Andrea.

Neither Andrea or myself are angry about having been operated upon as infants.  Because we are just plain old fashioned women who were born with transsexualism.  The person claiming we are angry because of having been mistreated as infants is confusing us with Tirea or with Chase.

But back to Italiano, Certified in Alternative Medicine means exactly nothing.

I am a stone Atheist. No god, no spiritual crap either.  No crystal healing, no aroma therapy.  I am as skeptical regarding all the new age “ancient wisdom of the east” as I am the pope and all other forms of religion.

Even Italiano’s description of premarin as a synthetic hormone belies a level of ignorance that is staggering.  Many of the objections to premarin are not due to its being synthetic (it isn’t as it is extracted from the urine of pregnant mares) but rather due to the level of animal abuse required to obtain it when ethinyl estradiol can be synthesized in a laboratory.

There are numerous sites and books that raise serious doubts regarding almost every form of “alternative medicine”.  Scientific research has failed to validate the claims of nearly every form of “alternative medicine” and label it of questionable if of any value.

The fact remains that the people who currently seem to be the most upset were not the original targets.  But since they seem to think the shoe fits.  So be it.

Tom Joad

This Blog is nearly one year old.  It has been through some changes.  Lots of people who came here at first are now denouncing me on their own blogs and over on TS-SI.

They are saying I betrayed them because I don’t embrace “classic transsexual” or HBS.  People are upset because while I think transsexualism is a form of intersex I haven’t believed Ayn Randian, individualist claims of special exemption due to “I’m not really like other transsexuals, I’m really intersex”” since Agnes story turned out to be a manufactured tale that got her SRS in the late 1950s.

I have been attacked as a traitor because people expected WBT to expend a lot of energy attacking transgender people and I refuse to. Transsexualism and transgenderism are different but when it come to oppression we are all “trannie queer gender trash”.

A lot of the expectations of my taking some sort of militantly anti-transgender stance and throwing the same shit at transgender folks as the Christo-Fascist right comes from where I was at for a short while about 9-10 years back when I was getting sober and in the aftermath of 9/11 and not reflective of a lifetime of left wing activism on my part.

I moved back to the left thanks to reading people like the late Howard Zinn and from revulsion towards the hate that was being spewed by the “classic transsexual” faction. Tina also played a major role in telling me how unbecoming my involvement in the near Fascism of the conservatives was and in reminding me of my basic working class New Deal Democratic roots.

When I am asked why I believe certain things and why I am a militant lefty, an anarchist, I joke and say, “It’s all Pete Seeger’s fault.” But I could as easily blame it on Joe Hill or Woody Guthrie and John Steinbeck.

A couple of years ago Tina and I watched the move Grapes of Wrath, and I recalled Tom Joad’s soliloquy.

Now Woody Guthrie saw the movie and wrote the following song.  After hearing it Steinbeck said, “Woody managed to tell the story that took me some 400 pages in about 6 minutes.

Some times on a lot of matters I think this might be a better world if  instead of asking “What would John Galt do?” we asked “What would Tom Joad do?”

Random Musings on being the out Liberal Feminist

Some times it is tough being an out Liberal Feminist.

Like when people expect me to think Obama represents me or that I think the Democrats are doing a good job.

When I in fact think that there really isn’t much difference between Democrats and Republican when it comes to representing the common people.  Tonight Obama is expected to announce a freeze on spending for all programs except the War Machine.  Is that any different than the Bush approach of tax cuts and borrowing money to feed the Moloch of the war Machine?

Here is Obama, the first African American President and he is more right wing than Eisenhower.  Hell Ike was a flaming liberal in comparison.

I know, I know I listen to Keith and Rachel as well as  XM Radio Thom Hartman, Ed Schultz and Stephanie Miller.  I hear all about all the good things Obama has done, supposedly.

Except even with an overwhelming majority in both the House and Senate our party of the so called left, our party that is supposed to represent progressive values hasn’t done shit.  The Republicans got more of their agenda through a Democratic majority Congress for the last 40 years than Obama has.

Two years ago I said “Hope is for dopes. I want programs not platitudes.”  I was a Hillary supporter.  I’m tired of the presidency requiring a dick as a major qualification.  As far as I am concerned having a dick and being a platitude spouting smooth talker was the only qualifications Obama had.  We rightly label Sarah Palin as unqualified because she is just a media creation and we should have done the same to Obama.

But more over this guy kissed up to Rick Warren and The Family, a bunch of religious zealots who are test marketing capital punishment for gays in Uganda.  He professed an admiration for Ronald Reagan, the President who started us on the road to out sourced Free Market hell.

So tonight Obama is planning on announcing he will adopt another part of the Republican agenda of shrinking funding for programs that actually benefit the American people.  But not the military.  After World War I General Smeadly Butler wrote a book titled “War is a Racket“,  As President, General Dwight D. Eisenhower warned us to “Beware of the military industrial complex.

We were supposed to believe Obama was different and would end the wars in Iraq and Afghanistan.  But we are still there, still murdering people with our outrageously expensive war toys, still torturing, still maiming in the name of freedom.

and I’m not really a liberal because liberals are way to complacent and wishy washy to say, “Not In My Name!”
