Idaho Gov. Butch Otter Signs Executive Order That Will End Medicaid In His State

Earlier this year, when the Idaho state legislature was considering an unconstitutional bill to nullify the Affordable Care Act, the state’s attorney general issued a stark warning against turning that bill into law. If Idaho passed a law refusing to comply with the Medicaid provisions of the ACA, it could opt itself out of Medicaid:

An additional legal ramification that must be considered as RS 20315 is contemplated is its effect on existing and future Idaho participation in the Medicaid Program. As a purely voluntary program, Idaho’s refusal to comply with the expanded provisions within the PPACA could potentially result in Idaho exiting the program and losing the existent federal matching funds. This could create a situation where individuals presently covered would no longer be covered, yet still require medical treatment, which likely would be required to be provided for and paid for through some non-federal means. This situation, in turn, could create an intense burden on the State’s budget.

Sadly, Idaho Gov. Butch Otter (R) did not heed the attorney general’s warning. Although Otter vetoed a nullification bill attacking the ACA yesterday, he also issued an executive order which effectively forbids his state from participating in Medicaid as soon as the ACA goes into full effect.

Medicaid is an entirely voluntary program in which the federal government provides generous grants to the states to administer a health program for their low-income residents. Yet Otter’s executive order forbids state agencies from implementing “any provisions” of the ACA, and it provides that “[n]o executive branch department, agency, institution or employee of the State shall accept or expend federal funds to implement the provisions of the []ACA.”

The reason why this is problematic is because, starting in 2014, the ACA requires states participating in the Medicaid program to offer health coverage to all persons under the age of 65 who earn up to 133 percent of the poverty rate. In return for expanding Medicaid, the federal government will provide each state with the lion’s share of the funds required to do so.

Archbishop Timothy Dolan is probably the one man in New York who can seriously derail marriage equality in that state. The man who longs to be Pope and convince the world that his beliefs are the only ones that are right has a flat out hatred of homosexuals, and a clear devotion to the protection of the Catholic Church when it comes to all matters regarding child sexual abuse. As Archbishop of Wisconsin, he oversaw the attempts to keep any and all information regarding the sexual abuse of deaf children at a Catholic run school from reaching the media. He has been upset over the coverage of the child sex abuse case in Philadelphia.

And now he is the target of Queer Rising.

On Sunday, 24 April 2011, Queer Rising is planning on protesting the Catholic Church’s instance in getting involved in American domestic politics.

Transsexual woman called attack ‘hate crime,’ has been afraid to be seen in public

A transsexual woman brutally beaten at a Baltimore County McDonald’s spoke out on Saturday, saying that the attack was “definitely a hate crime” and that she’s been afraid to leave the house ever since.

“They said, ‘That’s a dude, that’s a dude and she’s in the female bathroom,'” said Chrissy Lee Polis, who’s 22 and says she stopped at the Rosedale restaurant to use the restroom. “They spit in my face.”

A worker at the restaurant taped Monday’s attack and created a graphic video that eventually went viral on Friday. After the video garnered hundreds of thousands of views on websites, McDonald’s issued a statement condemning the incident and on Saturday, fired the worker that taped it.

The video shows two women — one of them a 14-year-old girl — repeatedly kicking and punching Polis in the head as an employee and a patron try to intervene. Others can be heard laughing, and men are seen standing idly by.

Toward the end of the video, one of the suspects lands a punishing blow to the victim’s head, and Polis appears to have a seizure. A man’s voice tells the women to run because police are coming.

It’s not the first time, Polis said, that she’s been picked on — physically — because of her sexual preferences. She said she’s been subjected to beatings and even sexual assaults.

She says seeing herself all over the Internet and all over the news has been “like walking out of the closet all over again.” Polis, who says she had a sex change operation to become a woman, is concerned that the public attention this has brought her could trigger more violence — and worries it could hurt her chances of getting a job. “I want to cry but I need to hold my head up,” she said.

Note – This is a repost of a February piece I wrote regarding Maggie Gallagher and NOM. I am presenting it again because it needed to be updated and also we need to be reminded of Gallagher and NOM’s duplicity.

These days, it’s relatively easy to be a talking head on news programs.

Just find some sucker with a lot of money willing to fund you, created an organization with an important sounding name, give yourself an important sounding but meaningless title (senior fellow, research analyst, president, etc.), and they’ll practically be beating at your door.

An incident recently on Fox News more than demonstrates that point. Not long after Attorney General Eric Holder announced that the Obama Administration would no longer defend DOMA, Fox News personality (you really don’t think I’m going to call her a journalist, do you) Megyn Kelly had National Organization for Marriage head Maggie Gallagher on her show to whine about how evil this decision is for families.

Of course Gallagher’s definition of families never seems to include lgbt families, leaving a lot of people out.

Nevertheless, Kelly allowed Gallagher to push her usual silly talking points, including one about how gays are inaccurately being compared to black people in terms of civil rights.

I sincerely hope that in discussing the DOMA decision – and hopefully this piece – no one falls for the divide and conquer technique of this person – Gallagher – who cares as much about the black community as she does the lgbt community.

And that level of care is zero.

What Gallagher and Kelly did were evasive tactics, much like other tactics Gallagher seems to have mastered when talking about gay marriage. Give her five minutes and she will try to pivot the conversation from the same-sex households negatively affected by her activism to how she and others like her are supposedly unfairly called “bigots” for supposedly simply trying to “protect marriage.”

Okay, let go on that angle. Let’s break down the acts of Gallagher and NOM and pose the question – are these the acts of a bigoted, homophobic organization or people simply trying to “defend marriage:”

November 20, 2009 – Signer of Manhattan Declaration wanted to jail gays and lesbians – By signing an anti-gay document, The Manhattan Declaration, Gallagher and NOM affiliates themselves with folks who want to jail lgbts.

February 1, 2010 – Maggie Gallagher commits ‘sin of omission’ to make case against marriage equality – Gallagher cites a study to bash gay marriage and gay parenting, even though the study had nothing to do with either concept.

March 8, 2010 – TinyU-R-Gay: @NOMupdates limits gay lives to less than 140 characters/years – A NOM tweet actually pushing the lie that gays have a short life span.

June 14, 2010 – National Organization for Marriage: Gays Were Never Hunted Down and Murdered Like ‘Jews, Christians, and Blacks’ – NOM is found to be affiliated with Louis J. Marinelli during its failed summer for marriage tour. Amongst other things, Marinelli claims that gays want to molest children. When Marinelli’s words became public, NOM claimed that the organization had no affiliation with Marinelli. However certain links posted as an update to the story demonstrated that NOM did have an affiliation with Marinelli. Editor’s note – earlier this month, Marinelli disavowed his work with NOM as well as many of the things he said in the past about lgbt. He is now a supporter of marriage equality.

June 28, 2010 – Message to Maggie Gallagher: associating with bigots does make you a bigot – NOM associates itself with another bigoted group, The Traditional Value Coalition. Amongst other things, TVC head Lou Sheldon has said that gays should be referred to as “sodomites.”

July 27, 2010 – National Organization for Marriage needs to disavow its ‘zany’ followers – NOM not only has a problem with the homophobia of those in its ranks, but also those who support the group, particularly the guy with the poster of the hangman’s nooses.

February 11, 2011 – PolitiFact catches anti-gay group NOM in a huge lie about gay marriage and children – Pultizer Prize-winning news site calls NOM out on a lie that gay marriage is being taught to kindergartners in Massachusetts.

February 17, 2011 – National Organization for Marriage called out AGAIN for distortive tactics – NOM commissions a misleading poll claiming that the majority of folks in Maryland oppose gay marriage. They are called out on it by a local columnist.

February 22, 2011 – National Organization for Marriage makes the case for being an anti-gay hate group – NOM pushes a piece written by syndicated columnist Mike McManus of the group Marriage Savers. The column has several distortions about gays, including the lie that gay men have a shorter life span than heterosexuals. NOM has not distanced itself from this piece.

April 14, 2011 – NOM Rhode Island’s Chris Plante: Gays’ marriages ‘turn children into little teacup dogs — it’s an accessory to put in my purse’ – A NOM leader in Rhode Island, Chris Plante, makes an offensive remark about same-sex families.

April 15, 2011 – Maggie Gallagher shucks and jives her way through the DOMA hearing – During a Congressional hearing on the Defense of Marriage Act, Gallagher says that gays and lesbians make wonderful parents and she does not understand how her past statements can be construed a “condemnation” of gays and lesbians and their “parenting skills.” However, Equality Matters (and myself) lists statements Gallagher has made in the past which were not so complimentary to the lgbt community

Again, I ask does this sound like a Christian defender of “the family” or a homophobic bigot exploiting fear and ignorance for a paycheck?

Sir David Attenborough has warned that population growth must be stopped in order to offer a ‘decent life’ for all.

The wildlife broadcaster said people were shying away from accepting that the world’s resources cannot sustain current levels of population growth.

‘There cannot be more people on this Earth than can be fed,’ he writes in the New Statesman.

‘The sooner we stabilise our numbers, the sooner we stop running up the down escalator – and we have some chance of reaching the top; that is to say, a decent life for all.’

Sir David, 84, said the global population is over six billion and will hit nine billion in 30 years, but ‘there seems to be some bizarre taboo around the subject’.

He warned of a ‘perfect storm of population growth, climate change and peak oil production’, leading to ‘insecurity in the supply of food, water and energy’.

‘We now realise that the disasters that continue increasingly to afflict the natural world have one element that connects them all – the unprecedented increase in the number of human beings on the planet,’ he added.

‘All these people, in this country and worldwide, rich or poor, need and deserve food, water, energy and space. Will they be able to get it? I don’t know.’

Sir David said there was a ‘taboo’ tackling the subject and that people shied away from stating the fact that a world’s resources cannot sustain current levels of population growth.

He said: ‘There seems to be some bizarre taboo around the subject. This taboo doesn’t just inhibit politicians and civil servants who attend the big conferences.

‘It even affects the environmental and developmental non-governmental organisations, the people who claim to care most passionately about a sustainable and prosperous future for our children.’

Hate Crime…

I saw the video on Bilrico…

The attack is a horrible Hate Crime.  I hope the video leads to the capture and successful prosecution of the perpetrators of this horrible attack and I further hope they are sentenced to many years within the Prison Industrial Complex and get to spend the rest of their lives regretting having committed this hate crime.

And it is a hate crime on several levels.  It is an anti-transsexual/transgender hate crime.  There is a racist element to the attack.  There is a gang element to it as well.

The “Thug Culture” promoted by so much of rap music and popular culture is almost like an indoctrination program that encourages black kids to commit violent acts that will result in long prison sentences. Pop culture aimed at the youth demographic encourages both violence and a psychopathic disregard for the well-being of others.

That goes hand in hand with the higher classes embrace of Ayn Rand inspired sociopathology.

That said I feel that many in the transgender community are acting like freaking vultures ready to exploit the horrible attack on this woman for the promotion of their own particular goal of including public accommodations in the ENDA bill they walked away from rather than tackle in separate parts.

It might be better to use this to promote Hate Crimes Laws which are also lacking in Maryland.

I know it would show a hell of a lot more concern for the victim of this brutal attack if people were to reach out to her with both financial and emotional support.  As well as legal support in filing a major lawsuit against not only the perpetrators but the punk who thought it would be cute to You Tube the video instead of helping the victim.

If a cup of hot coffee that caused burns was worth hundreds of thousands of dollars from Mickey D then failure to protect their customers from a brutal, brutal assault such as the one in the video should result in a million dollar judgment against them.

Earth Day: Conservationist or Communist? Behind Google’s Doodle

I just about fell off my chair when I read the latest right wing delusion.  Earth day is a Communist Plot.

Tell me again why I shouldn’t call them Nazis when communist or queer are their universal terms for anyone or anything they don’t like.

Though Earth Day still has its detractors, organizers expect more than a billion people to observe Earth Day today—a far cry from the movement’s grassroots beginnings in 1970.

Another big difference from the first Earth Day: Many will mark the day digitally in 2011—thanks in no small part to today’s Google Doodle, which publicizes Earth Day with an impossible animated Eden where pandas, penguins, and lions live in peace and an iceberg is just a pounce away from an African savanna.

And just this past Tuesday, the Washington, D.C.-based Earth Day Network—founded by the organizers of the first Earth Day—launched a new Facebook Web app to promote their Billion Acts of Green campaign. The project aims to generate a billion pledges of environmental service and advocacy before the Rio+20 Earth summit in Brazil from June 4 to 6, 2012.

One persistent rumor holds that April 22 was chosen because it’s the birthday of Vladimir Lenin, the founder of the Soviet Union.

“Lenin’s goal was to destroy private property and this goal is obviously shared by environmentalists,” according to a 2004 Capitalism Magazine article perpetuating the theory.

Likewise, shortly after the first Earth Day, a Daughters of the American Revolution member lamented to Time magazine, “Subversive elements plan to make American children live in an environment that is good for them.”

Members of Congress are back in their districts, attending town hall events, explaining to their constituents why, exactly, they want to make such major changes to the health care system.

If that sounds familiar, you might be wondering if we’re in for August 2009 redux. That was when conservatives and tea party activists caused mayhem at Democratic town hall events and sowed doubt in the minds of members and the media about whether the push for health care reform was really viable. Now, Republicans have their sites set on Medicare and Medicaid, and just voted, almost to a person, to basically zap both programs.

So are we in for a repeat?

Don’t bet on it. So far this week, we’ve seen a handful of video clips showing Republicans being interrogated by constituents — experiencing mild discomfort, but nothing like the genuinely frightening scenes two years ago, when large groups of coordinated, angry activists forced members to call off and cancel events. This is frustrating for progressives — but don’t be too quick to pin the blame entirely on Democratic and liberal ineptitude. It turns out there are plenty of non-obvious differences between then and now.

“I don’t think it’s possible to do that over again,” said Justin Ruben, executive director of MoveOn. “It’s like SwiftBoats in 2004. Interesting things happened in August, but it’s hard to repeat.”

Dissent Continues One Year After BP Disaster

Gulf Coast resident Cherri Foytlin still can’t get used to being called an activist. “A year ago, I was just a mom trying to protect my kids,” she says. “But I’ve embraced my new responsibilities respectfully and proudly.”

Foytlin marked the one-year anniversary of the BP oil disaster by walking 1,243 miles from New Orleans to Washington, DC to remind the country that even though the Obama administration and BP claim that life in the Gulf is back to normal, facts on the ground prove otherwise. She says people are experiencing everything from kidney damage to skin lesions, wildlife is dying, the economic devastation continues and the ecosystem has forever been damaged.

Foytlin arrived in DC on April 14 after 34 days of rainstorms, heat exhaustion, tornadoes and countless blisters. She says it was worth it.

“I’ve met so many people along the way,” she says. “Fisherman showed me crabs and shrimps with burn holes in them. I saw fish with no eyes. One man said, ‘I don’t understand. Why would you care about us?’ And he starts tearing up. At that point, I knew that this was about the people. I’ve been carrying them with me the whole time and sharing their stories.”

A mother of six whose husband lost his oil rig job after the disaster, Foytlin made international headlines in July 2010 after her emotional plea to President Obama aired live on CNN. “I am asking you, sir, as a patriot and as an honorable person, to come and hear our stories and hear the pain that we are in. We are crying out to you. Louisiana is crying out to you. We need your help.”

The people are still crying for help, but Foytlin says politicians and the national media aren’t listening.
Over the course of her journey, she was interviewed by several local and international outlets, but never heard from one national reporter. “We get more attention from the BBC and Al Jazeera English than CNN, ABC or NBC,” she says. “The national media bow down to the corporations. I hate to insult them, but the free press no longer exists. They have moved on. How many people have to die before they start telling the truth?”

On Earth Day, Recognize the Rights of Mother Earth

Happy Earth Day…

Stop Global Warming by starting the process of weaning from fossil fuels. Reduce consumption, recycle, repurpose, reuse.

Don’t reproduce. When possible eat locally.  Stop destroying the oceans, killing whales and end both long line and drift net fishing.

Place strict limits on Carbon emissions.  No fracking, no nukes, no deep water off shore drilling.  No more wrapping everything in non-recyclable plastic “clam shells”.

No more than one child per man/woman.  No serial reproducing with multiple men or women. One Child.

Stop the killing of wolves and whales.  No more blue fin tuna for sushi.

I don’t give a damn if it is your culture, killing tigers and rhinos for some part of them that makes your dick hard should be a capital offense.

If a grizzly or mountain lion attacks a human it is because the human invaded its territory.  You do not hunt down and kill an endangered creature because humans are stupid.

Earth First…  Stand for what you stand on…

This Earth Day, we need to start envisioning a future based not on exploiting nature but on recognizing that nature has inherent rights.

Ironically, this week also marks the one-year anniversary of the BP oil spill, the worst one in U.S. history.

Beyond headline-grabbing catastrophes, every day we dump 2 million tons of toxic waste into the world’s water, the equivalent of the weight of the entire human population.

Every day we literally blow the tops off of mountains to release hidden coal.

And it’s all legal, because under current law, nature is nothing more that human property, like a slave.

But thanks to some innovative thinking by governments, municipalities and indigenous peoples, a wiser mindset is taking hold. And the United Nations has also begun to consider the rights of nature.

This may be the first step toward the adoption of a Declaration on the Rights of Mother Earth. A companion piece to the Universal Declaration on Human Rights, this emerging declaration — which would be backed by enforceable laws around the world — seeks to redefine our human relationship with all other species from one of dominance to one of harmony.

Many places have already begun to change their laws in accordance with this new way of thinking.

On November 16, 2010, Pittsburgh became the first major U.S. city to recognize the legally enforceable rights of nature. Faced with dangerous “gas-fracking,” Pittsburgh’s city council unanimously passed a cutting-edge law that stops gas-shale drilling by elevating the rights of communities and nature above the interests of energy corporations.

Nearly two-dozen other U.S. municipalities have passed similar ordinances, finding that existing laws cannot protect their local ecosystems and, by extension, their human health, safety and welfare.

Canadian communities are also wondering if legally recognizing rights for nature can stop the privatization of their public water systems and halt dangerous tar-sands drilling in the fragile Alberta region.

And these bold municipalities are not alone.
